The parliament passed the law on the alimony of 2018: the size was increased and the punishment was tightened

The Verkhovna Rada adopted a law on strengthening the responsibility of unscrupulous parents, who are provided with an increase in the amount of alimony to the subsistence level.

230 people’s deputies voted to amend the draft law No. 8296.

– The minimum amount of alimony is increased to the subsistence level (1777 UAH from July 1 – Ed.). If the alimony is not paid within a year, then their amount automatically increases by 20%, if within 2 years – by 30%, – said in the margins of the Parliament, Minister of Justice Pavel Petrenko.

According to him, if alimony is not paid for more than 3 years, the amount of alimony is increased by 50%.

In addition, increased fines for parents who do not create the necessary conditions for life, education and upbringing of children. If earlier it was about the amount of hundreds of hryvnias, now the fine is from 850 to 1700 UAH, and for repeated violation during the year – from 1700 to 5100 UAH.

At the same time, the law provides for benefits for parents who develop children. That is, when filing an annual tax return, the amount will decrease by 18%. It is about the development of children in private kindergartens, English language courses and music schools.

This law also approved the new rules for the child’s departure abroad:

  • one of the parents with whom the child remained after the divorce decides the issue of his departure abroad for a period of not more than a month;
  • if the child travels abroad for more than a month, the parent with whom the child lives also may not receive a permit – if the second owes child support more than 4 months;
  • the parent with whom the child does not live, for travel with him abroad requires the notarized consent of the other parent; if he is not given such consent, you can go to court – but only if there is no debt for maintenance.

The law also tightens the responsibility for non-payment of alimony and increases the period of treatment and the period for which alimony can be collected: the aggregate amount of debt for non-payment of alimony up to 3 months for the purpose of public benefit work is reduced. In the case of a repeated administrative offense related to non-payment of alimony during the year, an administrative penalty in the form of public benefit works is envisaged for a period of 240 to 360 hours.

With regard to persons evading from serving an administrative penalty in the form of public benefit works, the law establishes administrative responsibility and provides for administrative arrest up to 10 days, and in case of malicious evasion – criminal responsibility and imprisonment up to 2 years.

The law will come into force one month after publication.

Let’s remind, debtors of alimony since February 6, in accordance with the law on strengthening the responsibility for non-payment of alimony, can not leave Ukraine and drive transport.
